These Terms and Conditions of Use ("Terms") constitute a legally binding agreement between you ("User") and Tachaz Private Limited, owner and/or operator of the TACHAZ platform.
These Terms govern your access to and use of the TACHAZ website, application, platform, software, services, communication facilities, profiles, content and related functionality (collectively, the "Platform").
By accessing, registering for, browsing or using TACHAZ, you acknowledge that you have read, understood and agreed to be legally bound by these Terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE TACHAZ.
TACHAZ is a technology platform designed to enable adults to create and maintain personal profiles, discover other registered users, communicate, share permitted content, and use other features made available from time to time.
TACHAZ is a technology and social-discovery platform. It does not itself provide personal, companionship, dating, entertainment, accommodation, transportation, employment or other services between users, and does not act as an employer, agent, broker or intermediary of any User. Users are independent persons using the Platform at their own discretion and risk.
Publication of user-generated content does not constitute an endorsement, recommendation, verification or approval by TACHAZ. TACHAZ does not represent or warrant that any User is who they claim to be, is trustworthy, has lawful intentions, or will behave appropriately.
TACHAZ is strictly restricted to persons who are 18 years of age or older. By registering, you represent that you are at least 18 years old, the information you provide concerning your age is accurate, and you have legal capacity to enter into these Terms.
You must not create an account on behalf of a minor, permit a minor to access your account, or upload content involving or depicting minors in prohibited circumstances. TACHAZ may terminate accounts where there is a reasonable suspicion of false age information.
You are responsible for ensuring that registration information is truthful, accurate, current and complete. You must not impersonate another person, create accounts using false information, use another User's account, or maintain multiple accounts to circumvent restrictions. You are responsible for maintaining the confidentiality of your login credentials and must immediately notify TACHAZ if you believe your account has been compromised.
You are solely responsible for the information in your Profile. You must not include information that is false, misleading, fraudulent, defamatory or unlawfully obtained, nor publish another person's personal information without consent. TACHAZ may remove or restrict Profiles that breach these Terms.
You must not use TACHAZ to facilitate, promote or participate in unlawful activity, including but not limited to: fraud, theft, extortion, blackmail, trafficking in persons, exploitation, harassment, stalking, identity theft, cybercrime, or any other unlawful activity.
TACHAZ must not be used to arrange, advertise, solicit, facilitate or promote unlawful sexual services, commercial sexual activity or trafficking. Nothing in these Terms authorises conduct prohibited by Zimbabwean law.
Users must not use TACHAZ to contact minors for prohibited purposes, solicit sexual content from minors, arrange sexual activity involving minors, or facilitate child trafficking.
TACHAZ does not participate in agreements or transactions between Users. Any communication, meeting or arrangement made between Users is made independently by those Users. TACHAZ is not a party to any agreement between Users, and Users are solely responsible for determining whether any proposed interaction is lawful.
Any decision to meet another User offline is made entirely at the User's own risk. Users are strongly encouraged to meet in public places, inform a trusted person, avoid unnecessary disclosure of personal information, and independently verify the identity of the person they are meeting. TACHAZ does not guarantee the safety, identity, intentions or conduct of any User.
By submitting content to TACHAZ, you grant TACHAZ a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and technically process that content solely as reasonably necessary to operate the Platform. You represent that you own or have permission to use the content and that it does not infringe another person's rights or contain unlawful material.
Users must not upload or distribute: child sexual abuse material; non-consensual intimate images; stolen personal information; content facilitating trafficking; malicious software; content threatening violence; defamatory material; or any material prohibited by applicable law.
Users remain solely responsible for their communications. Messaging functionality must not be used to harass, threaten, extort, defraud, stalk, or distribute unlawful content. TACHAZ may investigate reports of abuse and restrict access where reasonably necessary.
Users are encouraged to report suspected fraud, impersonation, exploitation, trafficking, harassment, abuse, underage users or other unlawful conduct. TACHAZ may investigate, remove content, restrict accounts or cooperate with authorities where appropriate.
TACHAZ may cooperate with Zimbabwean law-enforcement agencies, courts and regulators where legally required. TACHAZ may disclose information where required by court order, warrant, applicable legislation or other lawful obligation.
TACHAZ may collect and process personal information required to provide and secure the Platform, in accordance with applicable Zimbabwean data-protection law including the Cyber and Data Protection Act [Chapter 12:07]. TACHAZ's Privacy Policy forms part of these Terms.
Location information may not always be accurate. Users must not use TACHAZ to stalk, harass, monitor or threaten another person. Users must not rely solely on TACHAZ's location information to determine another person's exact whereabouts.
Any fees charged by TACHAZ relate to the Platform or Platform features and do not constitute payment to another User for personal services. TACHAZ does not guarantee the commercial or personal outcome of any interaction between Users.
TACHAZ may integrate third-party services governed by their own terms. TACHAZ and its licensors own the intellectual-property rights relating to the TACHAZ name, logos, software, interface and other TACHAZ-owned materials. Users receive a limited, non-exclusive right to use the Platform for its intended lawful purpose.
TACHAZ is provided on an "as available" basis without warranties, to the maximum extent permitted by Zimbabwean law. TACHAZ does not warrant the identity of Users, the accuracy of Profiles, the safety of Users, or uninterrupted availability.
To the fullest extent permitted by applicable Zimbabwean law, TACHAZ and its directors, officers, employees and affiliates shall not be liable for losses arising from user-to-user interactions, user-generated content, offline meetings, fraudulent or unlawful conduct by Users, or any indirect, incidental or consequential loss. Nothing excludes liability that cannot lawfully be excluded.
You agree to indemnify TACHAZ against claims arising from your use of the Platform, your content, your breach of these Terms, your violation of applicable law, or your conduct towards another User. You also release TACHAZ from claims arising from disputes between you and another User, to the fullest extent permitted by law.
TACHAZ may suspend, restrict or terminate an account where it reasonably believes these Terms have been breached, the User has engaged in unlawful activity, is under 18, or has abused another person. Where appropriate, a User may contact TACHAZ regarding an account restriction.
TACHAZ has a zero-tolerance approach to the exploitation of children. Users must immediately report suspected child exploitation through TACHAZ's designated reporting mechanism or directly to appropriate authorities.
TACHAZ implements reasonable security measures. Users must not attempt to hack, introduce malware or bypass security controls. Users should never provide another User with passwords, banking credentials, PINs or other sensitive security information. TACHAZ is not responsible for losses resulting from a User voluntarily providing funds or information to another User.
TACHAZ does not provide legal, financial or professional advice. TACHAZ may modify features, pricing or these Terms from time to time. Continued use after an amendment's effective date constitutes acceptance.
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Zimbabwe. Disputes shall be subject to the jurisdiction of the competent courts of Zimbabwe.
If any provision is found unenforceable, the remaining provisions continue in effect. TACHAZ's failure to enforce a provision does not constitute a waiver. These Terms, together with TACHAZ's Privacy Policy, constitute the entire agreement between you and TACHAZ. Nothing in these Terms creates an employment, partnership or agency relationship.
TACHAZ may communicate with Users through email, SMS, in-platform notifications or other contact details supplied by the User. Users are responsible for maintaining accurate contact information.
